An individual or group of individuals using the services or advice of the Placement Company (Internship Makers – IM).

Internship Makers’ Terms & Conditions:

General

The General Terms and Conditions set out by Internship Makers, hereinafter referred to as IM, are intended to define the contractual obligations established between the Client and IM as well as the conditions of sale.

The terms and conditions are to be consulted on the website: www.internshipmakers.com.

Please read these Terms & Conditions carefully. All IM’s services, offers and / or reservations are subject to these Terms & Conditions. Performing an Internship through IM, or subscribing to its offers of accommodation or additional services means that the below Terms & Conditions are accepted.

All IM’s Clients are obliged to act in accordance with the rules and regulations established by this legal agreement.

Definitions

Host Organization or Host Company:

The Host Organization or Host Company refers to any legal entity in which the Client undertakes his/her Internship. The Host Organization could be a company, a Non Governmental Organization (NGO) or any organization with a legal status authorizing it to host the Client for his internship.

Internship:

The Internship refers to a practical learning experience in which both, the Host Organization and the Client take part. The internship is not represented by a labor contract but by an Internship Agreement signed by the Host Company (not by IM) and the Client.

Internship Agreement:

The Internship Agreement refers to the contract between the Host Company and the Client.

Internship Offer:

The Internship Offer refers to the description of the Internship position a Host Company is searching candidates for. It includes the description of the tasks and missions of the position as well as the skills and qualifications required by the Host Company to fit the position.

Internship Package:

The Internship Package refers to the different services provided by IM and/or its Partner to place the Client for an Internship at a Host Company. Notably, it includes:

  • The review and correction of the Client’s CV
  • The sending of the Client’s application to Host Companies looking for interns,
  • The scheduling of interviews with the Host Companies interested in the Client’s profile (provided that the first payment has been paid by the Client)
  • when appropriate, the provision of advice about how to prepare a professional interview to maximize the chances of the Client to get an Internship (coaching session and /or advice booklet)

Accommodation Package:

The Accommodation Package refers to the different services provided by IM and / or its Partners to find accommodation for the Client. Notably, it includes:

  • The search for a private room or a shared room in a shared flat/house or for a private room or a shared room in a Host Family.
  • The coordination between the Client and the person in charge of the flat/house (Homeowner, Head tenant, Accommodation Company or Host Family) prior to the Client entering the accommodation.

Tutor:

The Tutor refers to any appointed person within the Host Company who will monitor the Client’s achievements throughout his/ her Internship. The Tutor will assign tasks and missions to the Client and provide him/her support and feedback for his/her work.

Accommodation Company:

The Accommodation Company refers to any company offering accommodation services to the Client (rental of apartments, shared flats, shared rooms, placement in host families).

Homeowner or Landlord:

The Homeowner or Landlord refers to a natural or legal person who owns a property in which the Client is accommodated.

Head Tenant:

The Head Tenant refers to a natural or legal person whose name is on the lease agreement with the Landlord and who is allowed to accommodate the Client as authorized by the Landlord.

Host family:

The Host Family refers to a natural or legal person who owns or rent a property in which the Client is accommodated. He / she offers accommodation full board or half board to the Client.

Partner Internship Company:

The Partner Internship Company refers to any Internship Placement Company cooperating with IM to provide Internship placement services to IM’s Clients. Indeed, in order to provide the best service to its Clients, IM sometimes collaborate with other Internship Placement Companies.

Taxi Company:

The Taxi Company refers to any company collaborating with IM in order to provide transportation services to the Client.

English School:

The English School refers to any habilitated language school collaborating with IM to provide English lessons to the Client.

Partner:

The Partner refers to any company, organization or natural or legal person employed or used by IM for its services (ex: Accommodation Company, Taxi Company, Cleaning Service Company, Partner Internship Company and any other service providers IM may collaborate with in order to provide services to the Client).

Acceptance:

The Client acknowledges having read, understood and accepted the Terms and Conditions. Data such as invoices, emails, Skype conversations, phone calls or data resulting from other means of communication will be recorded and constitute evidence to the Client’s commitment and acceptance of IM’s Terms and Conditions.

Articles

  1. Registration of the Client

    • Free registration, without any obligation to purchase.
    • The Client must provide his/her CV in an editable format (Word, Power Point etc.), in English, Spanish or French, depending on the chosen destination.
    • The level of English, Spanish, French or Dutch (depending on the chosen destination) of the Client must be sufficient to intern abroad.
    • The Client agrees to provide all the necessary information and communicate any information that may affect the smooth running of the Internship, the stay or the placement process.
    • Copy of a valid passport, VISA, work permit, resident permit and other documents may be required.
    • IM reserves the right to refuse applications if:
      • The Client fails to provide the requested information within an acceptable timescale
      • The Client has a criminal conviction for a serious offence or for one which is incompatible with the Client’s chosen destination
      • Anything that, in IM’s opinion, makes the Client unsuitable for the chosen destination or placement
    • IM retains all rights to reject the application of any person deemed unsuitable for the Internship Program and this, at its own discretion.
  2. Internship Makers’ (IM) commitments and liabilities

    • IM acts as an intermediary between the Host Companies, the Partners (e.g. Accommodation Companies, Taxi Companies, Cleaning Service Companies, Partner Internship Companies and any other service providers) and the Client.
    • IM agrees to put the Client in contact with Host Companies looking for interns according to his/her expectations, profile, field of study, skills and according to the requirements and expectations of Host Companies.
    • IM agrees to do its best to help the Client get his/her Internship, conducting actions such as:
    • Reviewing and correcting the Client’s CV,
    • Sending the Client’s application to Host Companies looking for interns,
    • Scheduling interviews with the Host Companies interested in the Client’s profile and willing to interview him /her, provided that the first payment of 80 Euros has been paid by the Client,
    • Reviewing and correcting any specific work / cover letter required by the Host Companies prior to conducting an interview with the Client or instead of such interview
    • When appropriate, providing advice about how to prepare a professional interview to maximize the chances of the Client to get an internship (coaching session and /or advice booklet)
      1. IM agrees to send the Internship Agreement signed by the Host Company back to the Client, after receiving the full payment of the Internship Package from the Client and under the condition that the Client has sent his/her Internship Agreement to IM within 2 days after having been accepted in internship by the Host Company.
      2. IM agrees to follow-up on the Client throughout the Internship and to do its best to ensure the smooth running of the Internship.
      3. IM cannot be held responsible for the behavior of the Host Company during the Internship. However IM agrees to help the Client resolve the potential problems of communication with the Host Company that might occur during his/her Internship, regarding: internship missions and/or working conditions (Cf Article 10) to the best of its ability.
      4. IM cannot be held responsible for the services provided by its Partners (e.g. Accommodation Companies, Taxi Companies, Cleaning Service Companies, Partner Internship Companies and any other service providers). However IM agrees to help the Client resolve the potential problems that might arise with its Partners to the best of its ability.
      5. IM agrees to be available for all relevant information required by the Client (e.g. information regarding his/her Internship or accommodation).
      6. IM cannot guarantee any Internship placement or accommodation placement within a specific timeframe. External factors (such as: interest from Host Companies, availability of Host Companies, behavior and speech of the Client during the interviews, availability of accommodation, visa approval etc.) prevent IM from being able to guarantee a specific date or timeframe.
      7. IM cannot guarantee remuneration of the Internships by the Host Companies.
      8. IM can stop all cooperation with the Client in the event his/her profile, expectations or project do not match the expectations and requirements of the Host Companies.
      9. Once the Client has accepted the Internship Offer and paid for his/her Internship Package, IM agrees to withdraw the Internship Offer from the market.
      10. IM undertakes not to disclose the Client’s personal information to commercial institutions or any other person or entity without the consent of the Client.
      11. IM is not legally responsible for the Client during the Internship, neither at the Host Company’s premises nor outside of the Host Company’s premises.
      12. IM takes no responsibility and is not liable for any accident, injury, theft, damage, disease, loss, cost or risk that may be incurred during the Internship or at the residence of any third party, including but not limited to the premises of the Host Company and the Client’s accommodation.
      13. IM’s maximum liability is limited to the amount paid by the Client for the service provided by IM. IM is not responsible for any extra costs that the Client may be incurred via external organizations prior, during or after his/her Internship or stay in the accommodation.
  3. Commitment, responsibility and behavior of the Client

    • Internship placement process:
      • The Client understands and agrees that, by contracting IM to search for an Internship and/or Accommodation or any other services, IM takes time to achieve the work requested by the Client. Therefore, IM asks the Client to pay an Internship Package, or an Internship + Accommodation Package or an Accommodation Package for the work done and time spent.
      • The Client agrees to follow the process step by step as described by IM.
      • The Client agrees to pay each invoice received from IM on time and for every service provided.
      • The Client acknowledges that any expected timeframe for his/her placement is given by IM for information purposes.
      • The Client agrees to inform IM about his starting and ending dates of Internship upon registration and / or during the first interview with an IM agent. Should any changes occur later on and the Host Company refuses the new dates of Internship, IM will not be considered as responsible and will not issue any refund.
      • The Client undertakes not to override IM’s recruitment process to obtain an Internship directly from the Host Companies of IM’s network. (Host Companies collaborating with IM are not entitled to accept the Client if he/she does not go through IM’s recruitment process and does not make the payments of the fees related to IM services).
      • The Client cannot contact the Host Company directly without the consent of IM before having paid the full amount of money due to IM for its services.
      • Once the internship agreement has been signed by the Host Company, it is the Client’s responsibility to have the internship agreement signed by their University, School or sending organisation and to send it back to IM scanned, by email. IM will not be held responsible for any failure to do so after returning the internship agreement signed by the Host Company to the Client.
      • IM understands that the Client may have to share some information related to his/her Internship or his/her Accommodation to external parties (e.g.: The Client’s University or School or the Client’s parents) so that the Internship placement or the Accommodation placement take place in the best conditions. However, the Client cannot disclose the contact details of the Host Companies or the Partners to a third party whose consultation or consent is not mandatory for the smooth running of the placement process (e.g.: Friends, classmates, or publication on social media) and this, neither prior, during or after the Internship or the stay in the Accommodation. Otherwise, IM reserves the right to cancel the Client’s Internship or Accommodation placement and take any legal action to preserve the interest of the company.
    • Financial resources of the Client:
      • It is the responsibility of the Client to have the financial resources to pay for IM services.
      • The Client must be sure he/she has enough financial resources before starting the process with IM.
      • It is the responsibility of the Client to be aware that traveling abroad is at a certain cost and it is necessary to have the financial resources to live in the country.
      • The Client agrees that IM will not be held liable for any inconvenience or loss of income due to the placement process.
      • It is up to the Client to secure any allowance mentioned in the Internship Offer, during the interview and/or during the signature of the Internship Agreement directly with the Host Company and not with IM.
    • Insurance and behavior of the Client:
      • It is the responsibility of the Client to have a public liability insurance and a medical insurance and/or a comprehensive insurance.
      • The Client is responsible for his/her own safety during the journey and during his/her stay.
      • The Client undertakes to behave respectfully during his/her Internship and his/her stay.
      • The Client must comply with the code of conduct of the Host Company. (Punctuality, respect of the corporate culture, adherence to the company policies, which may be set out in a staff handbook or verbally).
      • The Client is fully responsible for his/her acts throughout the Internship and/or the stay in the accommodation. He/she is liable for any loss or damage resulting from his/her The Client agrees to indemnify IM, the Host Company, Homeowners, Landlords, Head Tenants, Accommodation Companies, other service providers (taxis, cleaning services…) or any other party that may suffer any loss or damages due to the Client’s conduct. The Client must be insured for any damages or loss that can be caused during the internship or the stay.
      • The Client undertakes to respect the law of the country he/she will be doing his/her Internship in, and not to harm himself/herself or a third party. If the Client does not act in compliance with the facts set out above, he/she will be deemed fully responsible for the consequences of his/her acts.
    • Documents:
      • It is the Client’s responsibility to purchase his/her ticket to travel (and obtain a visa if required), and be available at the start date of the Internship. If the Client deviates from these conditions, no refund will be made.
      • It is the Client’s responsibility to obtain all necessary documents to travel abroad (including his/her VISA when necessary). IM cannot be held responsible if the Client does not get his/her VISA or any necessary document to travel / reside abroad and no refund of IM fees will be made.
  4. The Host Company

    • The Host Company is the sole decision-maker regarding the choice of applicants for the interviews and Internships.
    • The Host Company shall provide work missions and tasks matching the ones set out in the Internship Agreement established prior to the Internship.
    • Some Host Companies may NOT provide allowance, accommodation, refund of public transport or lunch. However the Host Company must comply with the Internship laws applicable in the country where the internship takes place.
    • The Client will be covered by his/her own insurance for the Internship. The Host Company is not obliged to provide insurance to the Client.
    • Any negotiations concerning schedules, bonuses, holidays take place directly between the Client and the Host Company.
  5. Accommodation general conditions

    • IM does not own any of the Accommodation proposed to the Client. For accommodation booking IM works with Partners (Homeowners, Head Tenants, Accommodation Companies, Host Families). IM is released from any responsibility attached to accommodation. IM only guarantees liaising with the Homeowner, the Head Tenant of the accommodation, the Accommodation Company and/or the Host Family to make sure the premises exist and the accommodation is equipped for short term rental.
    • IM cannot be considered responsible in case of loss, theft, non-recovery of the deposit, damages etc.
    • IM does not guarantee the proximity of the Host Company to the Client’s accommodation. IM undertakes to propose accommodation to the Client as close as possible to his/her Internship work place. However, it is possible that transportation time to the Host Company exceeds one hour and a half, especially during peak hours and in major cities.
    • The Client is responsible for personal belongings he/she keeps within the accommodation. He/she must close the door of the apartment or the house and windows for his/her own safety.
    • The Client cannot host a guest without the prior consent of the Homeowner, Head Tenant, Accommodation Company or Host Family. He/she may otherwise be evicted from the accommodation and/or may not recover his/her security deposit.
    • The Homeowner or Accommodation Company may move the Client from his/her room or accommodation if necessary (e.g. refurbishment, disagreement between roommates/flat mates…)
    • The Client is expected to respect the calm of the accommodation and neighborhood. He/she may otherwise be evicted from the accommodation and/or may not recover his/her security deposit.
    • The Client must pay the security deposit and first month rent before entering the Accommodation (this clause might change, as payment of the deposit and rent depends on Homeowners, Head Tenants and Accommodation companies).
    • The rent must be paid monthly by the Client on the dates scheduled with the Homeowner, the Head Tenant or the Accommodation Company. Payment of the rent will be made by the Client by bank transfer or in cash (depending on what has been agreed between the Client and the Homeowner, the Head Tenant or the Accommodation Company). If the Client is in arrears regarding the payment of his/her rent, he/she might be evicted from the accommodation without recovering his/her security deposit.
    • If the Client breaks or damages an item belonging to the Homeowner, the Head Tenant or the Accommodation Company, the Client will be held responsible and asked to reimburse it, otherwise it will be deducted from the deposit. If the amount of the deposit is inferior to the amount of the damage, additional expenses will be charged to the Client.
    • The Client must return the accommodation in a clean state (furniture as well as dishes) and must help to maintain the cleanliness of the common rooms (living room, bathroom, kitchen, toilet) during his/her stay. In case the cleanliness of the Accommodation or the state of the furniture is deemed unacceptable by the Homeowner, the Head Tenant or the Accommodation Company, part of, or the full amount of the security deposit (depending on the state of the Accommodation) may be kept and/or the Client may be evicted from the accommodation.
    • If the Client decides to move out from the accommodation earlier than the date initially agreed with the Homeowner, the Head Tenant or the Accommodation Company, it will be considered a breach of contract and therefore, the Client’s security deposit could be retained. The Client will be responsible for negotiating with the Homeowner, the Head Tenant or the Accommodation Company about the breach of contract and the return of the security deposit.
  6. Prices

    • IM reserves the right to change prices. However, the services are charged on the basis of the rates in effect at the date of the Client’s registration.
    • The prices are in Euros and include all taxes.
    • The prices do not include airfares, insurances, visa costs, excess baggage, airport taxes, food, public transport, excursions, activities, taxi transfers or the monthly rent of the accommodation.
    • IM and its Partner Internship Companies’ Fees :
  7. Payment of the 80 EUR fee

    • Process
      • Before receiving any payment, IM sends Internship Offers to the Client (after approving his/her application). IM cannot disclose the details of the Host Companies before receiving the payment of the 80 Euros fee.
      • The Client sends back to IM a ranking of the Internship Offers he/she would like to apply for.
      • IM corrects the Client’s CV, prepares the Client’s application and send the Client’s application to the Host Companies corresponding with the Internship Offers selected by the Client in his/her ranking
      • IM sends a first invoice of 80 Euros to the Client when a Host Company shows interest in the Client’s application. The Host Company can show its interest in the Client’s profile by either offering to organize a first interview (via Skype or phone) with the Client or asking for a presentation video from the Client, a written test or any kind of other test implying a decision about the Client’s application once it has been performed.
      • IM can propose other Internship Offers to the Client that he/she did not include in his/her ranking of Internship Offers. If the Client agrees to apply for them (via phone or via email), IM sends his/her application to the Host Companies related to these Internship Offers. If a Host Company shows interest in the Client’s application, IM sends the invoice of 80 Euros to the Client. The Client must pay the invoice.
      • Some Host Companies do not require interviews with the Clients to offer them an Internship and accept them directly for their Internship. In this case, IM sends a first invoice of 80 Euros to the Client; the Client must pay the invoice due and IM sends the information about the Host Company to the Client once it has received the payment of the 80 Euros.
      • The Client agrees to pay the 80 Euro fee after receiving the invoice issued by IM.
      • IM sends all the necessary information to the Client for him/her to prepare for his/her interview with the Host Company (advice booklet, name of the Host Company, website of the Host Company, contact of the Host Company) after receiving the 80 Euro payment from the Client.
      • It is the responsibility of the Client to ask all the necessary questions about his/her Internship, missions, dates of Internship, remuneration, working conditions, working hours, workplace during the interview with the Host Company or before accepting the Internship.
    • Payment and refund of the 80 Euros
      • All payments are secured and have to be made by bank transfer or via Paypal. Bank cheques or cash are not accepted.
      • The payment of the 80 Euro fee should be made within two days after receiving the invoice. Late payments are subject to a 10 Euro daily surcharge.
      • It is the responsibility of the Client to ensure that the payment by bank transfer or Paypal is possible and can be done on time.
      • Changes in currency rates are non refundable. Bank transfer fees are the responsibility of the Client.
      • IM may use the services of a debt recovery agency to ensure payment for its services.
      • The payment of the 80 Euro fee guarantees the sending of all the necessary information related to the Host Company to the Client for him/her to prepare his/her interview or any kind of test required by the Host Company. When the Host Company does not require an interview or a specific test to select the Client for his Internship, this information will also allow the Client to make a decision regarding the Internship offered by the Host Company.
      • Once the Client has paid the 80 Euro Fee, if the Client fails the first interview or test required by the Host Company, IM can organize a maximum of 3 interviews or tests with Host Companies. However, the Client understands and agrees that IM cannot guarantee the organization of other interviews or other tests as it all depends on the willing of the Host Companies and their interest in the Client’s profile.
      • IM cannot be held responsible if no (or no other) Host Companies are interested in the Client’s profile (for an interview or for a test).
      • For all the work achieved by IM, the invoice of 80 Euros issued by IM is due from the Client. The 80 Euros are at no condition refundable.
      • If the Client decides not to attend the scheduled interview with the Host Company, after receiving the invoice of 80 Euros, the 80 Euros remain due to IM from the Client.
      • If the Client decides to quit the placement process for any reason (including because he/she got an internship without IM) after receiving the invoice of 80 Euros, the 80 Euros remain due to IM from the Client.
      • If the Client changes his/her mind after being accepted by a Host Company (after interview or without interview), no refund of the 80 Euros will be made at any condition.
      • The cancellation of the Client’s application on the ground of, including but not limited to: change of mind, loss of interest in the Internship Offer, waiting for interviews with companies not linked with IM, having found another Internship by him/herself, change of dates of Internship, change of field of study, not having enough financial resources, not obtaining credit or any kind of grant, scholarship, VISA or any kind of other reasons, will not be considered valid reasons to either not pay the 80 Euros or for the 80 Euros to be refunded.
      • If the Client is deemed unprofessional at any stage of the process, (ie: wrong behavior towards the Host Companies, Host families, Accommodation Providers, or any other Partner) IM can evict the Client from the process and no refund will be made to the Client.
  8. Payment of the 80 EUR fee

    • Payment of the Internship Package
    • When a Host Company wants to offer an Internship position to the Client, it sends written evidence (email) to IM.
    • IM sends the Client the invoice for the Internship Package he/she chose (cf. article 7).
    • When a Host Company wants to offer an Internship position to the Client, the Client has 2 days upon receiving the Internship Package invoice, to accept or refuse the Internship.
    • If the Client fails in responding to IM within 2 days after receiving the Internship Package invoice, the payment of the Internship Package invoice will be due to IM in any case (shall the Client accept or refuse the internship after these 2 days).
    • The Client agrees to make the payment of the Internship Package invoice to IM, if he/she accepts the internship position, within two days after receiving the invoice.
    • In the event of the Client refusing three Internship positions, the Client will not be placed in any other Internship Position and the 80 Euros already paid will not be refunded.
    • Late payments are subject to a 10 Euro daily surcharge.
    • Once the Client accepts the Internship position, the Client agrees to send his/her Internship Agreement in English, via email, within 2 days following the acceptance of the internship by the Host Company. Otherwise IM cannot be held responsible in case of cancellation of the Internship by the Host Company or non-signing of the Internship Agreement by the Host Company.
    • If the Client fails in sending his/her Internship Agreement via email directly to IM, IM cannot be held responsible in case of cancellation of the Internship by the Host Company or non-signature of the Internship Agreement by the Host Company.
    • If the Client (or his/her School or University or any other third party) directly sends his/her Internship Agreement to the Host Company (via email or mail), IM cannot be held responsible of the non-signature of the Internship Agreement or the cancellation of the Internship by the Host Company.
    • Once the payment of the Internship Package invoice has been received by IM, IM sends the Internship Agreement signed by the Host Company to the Client.
    • The Client understands and accepts that certain delays may occur when returning the Internship Agreement signed by the Host Company. Indeed, the signature of the Internship Agreement by the Host Company is beyond the control of IM. The Host Company may take time to read the agreement, to have it read by a lawyer, to have it accepted by the director, to confirm the final dates of the internship etc. IM cannot be held responsible of such delays.
    • Once the internship agreement has been signed by the Host Company, it is the Client’s responsibility to have the internship agreement signed by their University, School or sending organisation and to send it back to IM scanned, by email. IM will not be held responsible for any failure to do so after returning the internship agreement signed by the Host Company to the Client.
    • In case of non-payment of the services provided by IM or its Partners, IM reserves the right to cancel the Client’s Internship and put back the Internship Offer on the market. In this case, the 80 Euros fees will not be refunded and the payment of the Internship Package invoice will still be due to IM for all the work achieved.
    • The cancellation of the Client’s Internship on the ground of, including but not limited to: change of mind, loss of interest in the Internship Offer , waiting for interviews with companies not linked with IM, having found another Internship by him/herself, change of dates of Internship, change of field of study, not having enough financial resources, not obtaining credit or any kind of grant, scholarship, VISA are no valid reasons not to pay the Internship Package or to ask for a refund of the internship package.
  9. Payment of the Accommodation Package

    • When a Client wants to book accommodation for his/her stay through IM, he/she needs to contact IM via email and provide his exact dates of stay.
    • IM will check if there is accommodation available for the Client. Then, IM will send pictures, descriptions, and prices of the different pieces of accommodation available for the Client. Pictures might not be available for the Host Families.
    • If the Client accepts the accommodation proposed by IM, the Client agrees to pay IM fee for the Accommodation Package in order to proceed to the booking of the accommodation.
    • If IM does not have any accommodation available for the dates given by the Client, IM will do its best to offer other options to the Client or send him/her contact(s) of Accommodation Partners and indicate him/her websites where he/she could find suitable accommodation by himself/herself.
    • The Client understands and agrees that IM is only an intermediary between the Clients, the Home Owners, the Head Tenants or the Accommodation Companies. Therefore, the payment of the rent and the security deposit will be paid directly to the Home Owner, the Head Tenant or the Accommodation Company. The payment for the booking of Host Families however will be made to IM.
    • The Client understands and agrees that IM is not responsible for the refund of the security deposit at the end of the lease and/or for any problems he/she may encounter with the Accommodation Provider (the Home Owner, the Head Tenant, the Accommodation Company or the Host Family). However, in the event of a problem between the Client and his/her Accommodation Provider, IM will do its best to find a solution by contacting both the Client and the Accommodation Provider.
  10. Change of Host Company or refund of the Internship Package:

    • In the event of a problem with the Host Company, the Client must contact IM before the end of the Internship so that solutions may be found.
    • When the Client did not start his/her Internship yet:
      • The cancellation of the Client’s Internship on the ground of, including but not limited to : change of mind, loss of interest in the Internship Offer, waiting for interviews with companies not linked with IM, having found another Internship by him/herself, change of dates of Internship, change of field of study, not having enough financial resources, not obtaining credit or any kind of grant, scholarship, VISA are no valid reasons not to pay the Internship Package invoice or to ask for a refund of the Internship Package.
      • The Client understands and agrees that, by contracting IM to search for an Internship and/or Accommodation or for any other services, IM takes time to achieve the work requested by the Client. Therefore IM asks the Client for fees for the work achieved and the time spent.
    • When the Client already started his/her Internship:
      • A Client’s request for a change of Host Company will only be considered under the following conditions:
        • Sexual harassment or moral harassment.
        • Racial or religious defamation.
        • Failure of the Host Company to keep providing the internship.
        • Declaration of Bankruptcy from the Host Company.
        • Breach of security or health measures, which may harm or affect the Client.
        • Missions and tasks given to the Client not in relation with the ones specified on the Internship Agreement between the Client and the Host Company.
      • In the event of the Client complaining about his/her Internship, IM agrees to listen to his/her complain and do its best to resolve the situation.
      • Should the Client experience any problems whilst partaking in the Internship or Accommodation placement, the Client must first contact his/her tutor from the Host Company or his/her Accommodation Provider in order to find a solution. If this approach is not successful, the Client has to contact IM by phone (00356 27 52 20 22) to clearly explain the situation. In such an event, IM will discuss the problem and ways in which it can be solved with the Client. IM will contact the Host Organization or the Accommodation Provider and offer to organize a meeting or a call conference between IM, the Client and the Host Organization or the Accommodation Provider to find appropriate solutions. Only what is recorded in a written form either by email or by letter will be taken into account.
    • If the Client is not satisfied with the Internship for a valid and justified reason (see section 10.3.1) and solutions cannot be found, IM agrees to do its best to find another Internship that meets the Client’s profile and his/her field of activity (depending on the availability of Host Companies, length of internship remaining (minimum 3 months) and the Client’s level of English (minimum B2 level according to European Classification)).
    • In case the Client decides to terminate the Internship by him/herself without prior advise to IM, or if the Host Company decides to terminate the Internship of the Client due to inappropriate behavior (verbal or physical abusive behavior, racist behavior, drug-taking, alcohol, misconduct, insubordination, behavior deemed unacceptable by the tutor or managers of the host company or professional negligence of his/her work missions, non-compliance with company’s rules), IM reserves the right not to refund the any of the Packages the Client paid for and not to place the Client in another Host Company.
  11. Internship Makers’ Partners

    Depending on the situation, IM can sometimes work with different partners such as:

    • Accommodation Company: The Accommodation Company refers to any company offering accommodation services to the Client (rental of apartments, shared flats, shared rooms, host families)
    • Homeowner or Landlord: The Homeowner or Landlord refers to a natural or legal person who owns a property in which the Client is accommodated
    • Head Tenant: The Head Tenant refers to a natural or legal person whose name is on the lease agreement with the Landlord and who can accommodate the Client when authorized by the Landlord
    • Host family: The Host Family refers to a natural or legal person who owns or rent a property in which the Client is accommodated. He / she offers accommodation full board or half board to the Client
    • Partner Internship Company: The Partner Internship Company refers to any Internship placement company cooperating with IM to provide internship placement services to IM’s clients. Indeed, in order to provide the best service to its Clients, IM sometimes collaborate with other Internship Placement companies.
    • Taxi Company: The Taxi Company refers to any company collaborating with IM in order to provide transportation services to the Client
    • English School: The English School refers to any habilitated language school collaborating with IM to provide English lessons to the Client
    • Partner: The Partner refers to any company, organization or natural or legal person employed or used by IM for its services (ex: Accommodation Company, Taxi Company, Cleaning Service Company, Partner Internship Company and any other service providers IM may collaborate with in order to provide services to the Client).
    • The Client understands and agrees that, according to the services required, he/she might also be put in contact with these Partners.
  12. Unavoidable circumstances

    IM and its Partners or suppliers are released from their contractual obligations upon the occurrence of a force majeure event, or any act attributable to a third party, or any other circumstances or external cause independent from IM staff, directly or indirectly preventing IM from meeting its contractual obligations. Cases of force majeure include, without limitation, in addition to the cases recognized by the courts, all natural disasters, acts of war, public order offenses, epidemics, fires, floods and other disasters, acts of any government, all strikes in any form whatsoever (internal, external, …) and any malfunction of the Internet or networks. No refund will be due to the Client for the services of IM and its Partners or suppliers.

  13. COVID 19

    • By applying for the internships offered by IM, the Client is aware of the global health situation and understands the risks (health, financial, etc.) involved in traveling abroad.
    • The Client undertakes to comply with the measures required by governments upon entry into their territories (PCR test, isolation, social distancing, wearing of masks, compliance with curfews etc.).
    • IM will not be held responsible if the Customer cannot finally reach the intended destination country or place of internship (border closures, cancellation of the internship by the Client himself or his school, quarantine, contamination, loss of a relative, remote work required by the company etc.).
    • If the Client is unable to travel to the internship location as agreed, IM undertakes to request from the Client’s Host Company the possibility for the Client to carry out the internship remotely or to change the dates of the internship. However, IM will not be liable in the event of refusal by the Host Company and no refund will be made.
    • The Client understands that IM is a service company and that once IM agents spend time on Client’s application to find an internship and services started to be provided (interview, application processing, etc.), no refund will be made.
    • The Client understands that if he/she advances a deposit for accommodation and he/she cannot make it on the date indicated, the deposit cannot be returned.
    • If the Client occupies an accommodation and wishes to leave it of his/her own free will, before the end of the defined rental period, the deposit cannot be refunded, nor can the rent already paid.
  14. Confidentiality

    IM understands that the Client may have to share some information related to his/her Internship or his/her accommodation to external parties (e.g.: The Client’s University or School or the Client’s parents) so that the Internship placement or the Accommodation placement take place in the best conditions. However, the Client cannot disclose the contact details of the Host Companies or the Partners to a third party whose consultation or consent is not mandatory for the smooth running of the placement process (e.g.: Friends, classmates, or publication on social media) and this, neither prior, during or after the Internship or the stay in the accommodation. Otherwise, IM reserves the right to cancel the Client’s Internship or accommodation placement and take any legal action to preserve the interest of the Company.

  15. Applicable law and dispute resolution

    • These Terms & Conditions are valid from the 01st of January 2018 and are subject to the laws of Malta. If changes are made to the Terms and Conditions, they will be valid at the time of their publication on IM website.
    • This contract is subject to the laws of Malta. The sole jurisdiction in any dispute is the court of Malta.
    • These Terms and Conditions represent a contract between the Client and IM.
